INVESTIGATIVE UNIT: Rape kit never tested in Angola Assistant Warden case

BATON ROUGE- There's a twist tonight in an alleged rape case in West Feliciana Parish. The district attorney now admits an assistant warden and a woman had sex, but claims it was consensual.

Tonight, we've learned the rape kit administered in this case wasn't even tested. All of this surrounds a no true bill by a grand jury with the case against Barrett Boeker. A no true bill means the grand jury decided there wasn't enough evidence for Boeker to face rape charges.

Boeker is essentially cleared of wrongdoing. Yesterday, the woman who accused him of attacking her told WBRZ she felt he got special treatment by the district attorney in West Feliciana Parish where the case was handled. The WBRZ Investigative Unit reported extensively on Boeker getting three bond reductions before he managed to get out of jail. That is something those in the legal community called unusual.

East Baton Rouge Parish Coroner Dr. Beau Clark said the rape kit that was administered is still sitting on a shelf at his office. That's because detectives in West Feliciana Parish never came to pick it up and take it to the State Police Crime lab.

District Attorney Sam D'aquilla declined to do an on camera interview, however he answered all of our questions by phone. He says there were many problems with this case. He claims the sex was consensual which is why there was no need to introduce a rape kit. He also says there were a lack of witnesses willing to come forward.

"That DA did not represent me," Priscille Lefebure, the alleged victim said. "He was there to represent Barrett Boeker."

Area district attorneys called this particular case unusual and said they would have wanted any evidence possible at their fingertips for a grand jury hearing. That's not what happened in West Feliciana Parish.

"I don't know how this happened, or how he got away with this," Lefebure said.

District Attorney Sam D'Aquilla says he has no intention to bring this case back before a grand jury unless there's some new evidence.
He says the results from the rape kit are meaningless since he knows they had sex. The attorney representing the assistant warden is a distant relative to D'Aquilla.
