Dad booked with negligent homicide in crash death of 9-year-old son

BATON ROUGE -State Police have arrested a Utah father on a negligent homicide charge after his son died in a crash here this past weekend.

On Saturday, Elmer Menendez, 32, and his son 9-year-old Fernando Menendez were in a pickup truck on Highland Road east of Siegen Lane when the elder Menendez lost control of the truck. The truck spun along the road and crossed into oncoming traffic, where it was hit by an SUV driven by Ron Adams, 46, of Baton Rouge. Adams' SUV smashed into the pickup truck on the passenger side.

Neither Elmer nor Fernando Menendez were wearing seatbelts at the time of the crash. Both were ejected from the truck and Fernando was pronounced dead at the scene. Elmer Menendez and Adams were injured in the crash.

Investigators said at the time of the crash that Elmer Menendez would be booked into jail when he was released from the hospital. He was booked Thursday with negligent homicide, not having a child restrained properly and not wearing his seat belt.
