Church wants suit dismissed
BATON ROUGE- The Diocese of Baton Rouge wants a Judge to throw out a major portion of a lawsuit against a priest.
The lawsuit says the priest was told about allegations of sexual abuse during a confession, and did not report it to authorities.
Rebecca Mayeux claims she was molested by a parishioner at a church in Clinton, when she was 14-years old. Mayeux claims she went to her priest, Father Jeffrey Bayhi for advice during a confession, but he did not report the alleged abuse.
Here's what the church wants. The Diocese of Baton Rouge, is asking a judge to dismiss everything Rebecca Mayeux told the priest, during three separate confessions in 2008.
The church says, Father Bayhi was not required to report any communications with Rebecca Mayeux that occurred during the sacrament of reconciliation.
The Diocese contends that Father Bayhi did not have any duty under state law to report Mayeux's claims of abuse. If a judge rules in favor of the church, it would dismiss much of the meat of Mayeux's lawsuit.
That would leave the plaintiff's with a case that centering on her alleged abuser, George Charlet Jr., which includes claims of molestation, and sexually charged text messages and diary entries along with any communications she told the priest outside of confession.
Mayeux and her attorney contend, there were additional conversations where she told the priest about the alleged abuse outside of confession.
It's unclear when this new motion that was filed will go to court...or how long it will take for a judge to make a decision. All sides have agreed Father Bayhi will not testify if this case goes to trial.
