Chappelle banana peel case tossed
ALBUQUERQUE, NEW MEXICO- Comic Dave Chappelle refused to testify in a case where a man threw a banana peel at him because Chappelle was making jokes about his friend and the case was dropped.
Christian Englander faced misdemeanor battery and disturbing the peace charges. The incident happened in March and Chappelle said the act was racist.
Charges can be refiled if Englander fails to perform 22 hours of community service under the conditions of the dismissal.
Prosecutors admitted a conviction was unlikely without the testimony of Chappelle.
