Education reform package in court again

BATON ROUGE - The Louisiana Federation for Teachers is challenging another part of Governor Jindal's education reform package, this time taking aim at the constitutionality of a portion dubbed the 'talent act.'

The act deals with teacher tenure, hiring, firing and evaluations. New rules allow the Superintendent to hire and fire instead of the school board. It also allows school districts to set pay scales and reward teachers for excellent work.

The LFT claims the way the act was passed is unconstitutional because it encompasses more than one object, instead of allowing lawmakers to vote on each change separately.

"The way that act was passed is wrong, it was wrong, it doesn't pass the fairness test, it doesn't pass the test that the people put before legislators, and we all know that tremendous muscle was asserted by the governor's office," said Steve Monaghan, President of the LFT.

The state claims the act encompasses changes all aimed at the same goal, and therefore shouldn't be deemed unconstitutional, but the LFT still thinks the changes were lumped together to push the law through the legislator.

Judge Michael Caldwell will decide on the constitutionality of the law tomorrow in 19th Judicial District Court.
