BRUSLY - A police chief accused of stealing while on the job gets to keep his job for now.

Brusly Police Chief Jamie Whaley was arrested last week for using department gas cards for personal use. On Monday he spoke briefly with News 2 over the phone, initially saying he would release a statement regarding his arrest. He later chose not to on advice from his lawyer.

Whaley also refused to go on camera. But he said that as an elected official, he has no intention of stepping down or resigning his position as Chief of Police in Brusly. He was arrested by West Baton Rouge deputies Thursday and charged with theft and malfeasance in office. Investigators with the FBI and the Inspector General's Office said he was caught on video running up a bill of more than $1,000 in gas for his personal car and his boat.

Whaley posted bond and is now awaiting his court date.
