Woman jailed for weeks, sues over rental car issue
BATON ROUGE- A woman in Baton Rouge said she spent over 21 days in jail over a paperwork error.
Percival Franklin is not the type of person who gets into trouble. But trouble began for her in 2006, when she rented a car from Hertz Rental at Metro Airport. She'd been in a crash in her personal vehicle and needed something to get around in.
Franklin claims she later extended her rental agreement for several months while she tried to figure out what car to buy. However, Hertz reported the car stolen.
While Franklin was on a work trip in Michigan she decided to go to Canada. Upon her return to the United States, she learned there was an arrest warrant pending for auto theft in Louisiana.
"I was detained 21 days," Franklin said.
Officers from Baton Rouge traveled to Michigan to bring Franklin back to Louisiana. Court documents show the criminal charges were dropped, but Franklin is now suing Hertz in civil court for being wrongfully incarcerated.
"I've never stolen a vehicle in my life," Franklin said. "I'm a professional counselor."
Franklin claims Hertz did not keep proper computer files on her rental agreement, which made it hard to track who she called to extend her rental agreement.
The attorney representing Hertz told News 2 by phone he wasn't at liberty to discuss the case.
As for Franklin, she wants others to know what happened to her to prevent this from happening again.
"Keep all documentation, that's great," Franklin said, "but even when they keep documentation, that is not sufficient."
