A prisoner who requested the firing sqaud for execution in Utah lost an appeal before the state Supreme Court. Ronnie Lee Gardner cannot challenge the signing of his death warrant. The justices agreed with prosecutors that a sentence can be appealed but not the order to carry out the sentence. Gardner is set to die June 18. He was sentence to death for murdering a lawyer in 1985. He has a separate appeal before the court next week and the state parole board will also hold a hearing to commute his sentence.
