A defense attorney's court filing Monday says the state and federal cases against Sgt. Kenneth Bowen improperly used his 2006 testimony before a state grand jury made under an immunity deal.
The state case against Bowen and other officers was dismissed, but he and five others were indicted on federal charges stemming from shootings on the Danziger Bridge less than a week after the August 2005 storm.
Bowen's attorney, Frank DeSalvo, claims a buffer federal prosecutors supposedly set up to insulate the federal case from Bowen's immunized testimony doesn't exist.
