Mistakenly released illegal with lengthy record wanted by deputies

BATON ROUGE - Deputies blame a clerical error for the reason an illegal immigrant was allowed to bail out of prison despite being wanted by federal immigration agents.

Friday, East Baton Rouge corrections officers released Bernardo Gomez, 27.  But, he was supposed to be held in jail for ICE agents.

Gomez, an illegal alien, was arrested on seven counts of drug distribution.  The day before his release, U.S. Immigration and Custom Enforcement officers asked the prison to put a hold on Gomez.

"When you have tens of thousands of people flooding across the border, of course you're going to have miscommunication," State Representative Valarie Hodges said.

She blamed the mistake not on the prison, but on the nation's immigration policy.

"If he gets deported back to where he is from, then he could be back in 24 hours," the Denham Springs representative said.

Gomez has done just that before. In March 2013, Jefferson Parish authorities arrested Gomez on cocaine charges. Then, in April 2013, U.S. Marshals arrested him on drug charges in Ascension Parish.  In June, he was busted in Orleans Parish and authorities say ICE agents deported him back to his home country.

But, months later he was back in Louisiana.  This time, on the streets of East Baton Rouge where he was accused of selling drugs. 

Now, there is a warrant for his arrest becasue of his accidental release.
