Man sentenced for dumping hazardous waste into BR water system

BATON ROUGE- A man in Baton Rouge who illegally dumped six million gallons of hazardous waste over a three-year period will not do any jail time.

Roger Dies faced a lengthier sentence for his actions but was given two years federal probation instead. He also must pay hefty fines.

Dies owns Baton Rouge Truck Wash off of Plank Road. The hazardous waste which caused big problems at the city-parish water treatment facility was ultimately traced back to his business.

Federal prosecutors said he received nearly $371,000 to dispose of third party waste. They also contend that he made false statements and created false documents related to the disposal of the waste. Dies had to forfeit the $371,000. He was ordered to pay a $104,000 fine after the corrosive materials he dumped tore through pipes and broke three expensive pumps at a nearby sewer plant. Dies also was ordered to pay a $6,000 fine.

In court, Dies apologized to Judge Shelly Dick and the city-parish.

"I made some mistakes, some pretty big ones," he said. "I'm sorry. It's quite a bit to absorb. I apologize to the city and to the court. I am responsible. I just have to plead with the court. I have an ailing mother and am raising a grandson."

Judge Dick told Dies her sentence had no reflection on his family situation.

Dies' attorney, John McLindon said changes have already been made in the way he conducts business to prevent this from happening again.

"He no longer accepts third party waste water anymore," McLindon said. "He was in violation of his permit, but still treated the water. It's important for the public to know that."

As part of Dies' probation he'll have to remain drug- and arrest-free. He had no prior convictions.
