PORT ALLEN - A man, accused of hiring a hit-man to kill a Port Allen couple over a soured business deal, won't be getting out from behind bars in West Baton Rouge Parish anytime soon.

Prosecutors say Tommy Gioele is too high a risk to be let out of prison and stripped away his possibility of bonding out during a hearing yesterday.

"I've asked for no bond excessive of $1 million because I believe if he gets out there will be serious harm done to my victims," said Lead Prosecutor Tony Clayton.

"I don't think they're victims at all," said Jimmy Gioele. "I think Tommy Joe's the victim."

Tommy's brother says the wrong person is behind bars, describing his brother as an upstanding citizen who got caught with his back against the wall.

"They messed my brother out of a million dollars, what would you do?" Jimmy asked. "It was a crooked situation, they sold him a million dollar building that had liens on it."

The drama started in 2007 after Gioele purchased Camile's Cajun Café from its owner. Less than a year later he was filing suit, claiming the owner breached their contract and made future success of the eatery, impossible.

According to court documents Gioele paid a would-be hit-man $300 to buy a gun to kill the owner and his wife.

But, according to the Affidavit, he went immediately to police who shortly after recorded Gioele giving the hit-man advice on the escape routes and arranging payment.

"I have evidence that causes serious concern," Clayton said. "That he would go out and attempt to finish the job he started."

Gioele was arrested in December and charged with two counts of soliciting murder. He'll go before a grand jury February 12.
