Judge tosses indictment against BR lawyer
BATON ROUGE- A state district judge has thrown out a 2010 indictment against Baton Rouge lawyer Peter Q. John.
Judge Mike Erwin dismissed the indictment accusing John of conspiracy, obstruction of justice, theft and perjury.
Erwin agreed with John and his attorney, Ferdinand Valteau, that East Baton Rouge Parish prosecutors have waited too long to bring John to trial. They argued the two-year statute of limitations prevented John's prosecution from continuing.
Prosecutors have not decided whether to appeal the ruling.
