Judge refuses to move ex-cops' retrials from N.O.

NEW ORLEANS - A federal judge has refused to transfer the venues of retrials for two former New Orleans police officers charged in a deadly shooting following Hurricane Katrina.

U.S. District Judge Lance Africk on Friday rejected the requests by David Warren and Travis McCabe to move their respective retrials out of the New Orleans area.

Lawyers for Warren and McCabe argued that media coverage of their clients' first trial has tainted the pool of prospective jurors in the Eastern District of Louisiana. Africk said an impartial jury can be seated by carefully questioning members of the jury pool.

Warren is charged with fatally shooting 31-year-old Henry Glover without justification outside a strip mall less than a week after the 2005 storm. McCabe is charged with writing a false report on Glover's shooting.
