Appeals court refuses to block recall election
A five-judge appeal court panel has turned down Wilson Mayor Joshua L. Thomas' challenge to a Saturday election on the question of whether he should be removed from office.
Charles Griffin, attorney for the recall election supporters, said five judges of the state 1st Circuit Court of Appeal in Baton Rouge heard arguments in the case and ruled Wednesday.
Griffin said a state district judge last week turned down the mayor's bid to halt the election on the grounds that the recall petition was not handled properly.
The appellate panel ruled the mayor had failed to timely appeal a ruling dismissing the secretary of state as a defendant and the remaining defendants do not have the power to stop the election.
