New Orleans police have charged a 28-year-old man with vehicular manslaughter and driving while intoxicated after the car he was allegedly driving plunged into a canal.

The New Orleans Police Department said in a news release that a 24-year-old man died in Sunday's accident and a 27-year-old man was in critical condition.

Their names were withheld pending notification of relatives.

Investigators said driver of the 2006 BMW, Percy Johnson, allegedly ran a stop sign, lost control and ran into a canal. Johnson and three men escaped, but two others were trapped. The accident happened about 2:30 a.m.

It wasn't immediately clear if Johnson had a lawyer.

Police were awaiting the results of a toxicology test.
